Terms of Use
PLEASE READ CAREFULLY. These Terms of Use ("Terms") form a binding agreement between you and BluebonnetBuyer Home Savings, LLC, a Texas limited liability company doing business as "BluebonnetBuyer" ("we," "us," "our," or "Company"), and govern your access to and use of bluebonnetbuyer.com and all related tools, content, and services (the "Service"). Section 14 contains a binding individual arbitration agreement and class-action waiver that affects your legal rights. By accessing or using the Service you agree to these Terms, our Privacy Policy, Disclosures, and Fair Housing Statement. If you do not agree, do not use the Service.
1. Eligibility & account
You must be at least 18 years old and legally capable of entering into a binding contract to use the Service. You agree to provide accurate, current, and complete information when you register and to keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. Notify us immediately at admin@bluebonnethomesavings.com of any suspected unauthorized access. Professionals ("Pros") must hold and maintain all licenses (TREC and any other applicable license) required for their activity for as long as they are on the platform.
2. Educational service — not a lender, broker, brokerage, or advisor
BluebonnetBuyer is an independent consumer information platform. We are not a mortgage lender, mortgage broker, real estate brokerage, law firm, accounting firm, tax advisor, financial advisor, or insurance agency. Nothing on the Service is, or should be construed as, a loan offer, commitment to lend, pre-approval, rate quote, rate lock, appraisal, legal advice, tax advice, financial advice, investment advice, insurance advice, or real-estate advice. Only an appropriately licensed professional can advise you on your specific situation. Always verify program rules, eligibility, funding availability, and lender terms with the administering agency and a Texas-licensed professional before making any decision.
3. Program information — no warranty of accuracy or availability
The Service includes general information about down-payment assistance ("DPA"), Mortgage Credit Certificates ("MCC"), grants, bond programs, builder incentives, and other homeownership-assistance opportunities operated by independent federal, state, county, municipal, and nonprofit agencies. Program availability, eligibility requirements, income and purchase-price limits, funding levels, interest rates, and program terms may change or be suspended at any time without notice. We make no representation, warranty, or guarantee as to the accuracy, completeness, currency, or continued availability of any program shown on the Service. You are solely responsible for verifying current program requirements and funding status directly with the administering agency and a Texas-licensed lender before relying on any information shown here. Calculator outputs are illustrative estimates only and are not loan offers, pre-approvals, rate locks, quotes, appraisals, or guarantees of eligibility, funding, or savings.
4. Third-party professionals
Texas-licensed real-estate agents and other professionals identified through the Service ("Pros") are independent third parties, not our employees, agents, partners, or joint venturers. We screen license status at onboarding but do not supervise, control, or warrant the performance, conduct, advice, recommendations, fees, fitness, or outcomes of any Pro. Any contract, engagement, agency relationship, or transaction is solely between you and the Pro, and we are not a party to it. You are solely responsible for independently evaluating any Pro and verifying their license, disciplinary history, references, and qualifications at TREC. We do not recommend, endorse, or rank any Pro based on compensation paid to us; placement is determined by capped market tiers and round-robin order.
5. No guarantees
We make no representation, warranty, or guarantee regarding loan approval; mortgage interest rate or pricing; DPA, MCC, or grant eligibility, amount, or funding; closing-cost outcomes; tax outcomes; property values; the number, quality, or timing of leads a Pro will receive; or the outcome of any real-estate transaction. Phrases such as "may qualify," "potential savings," "programs available," or "could help identify opportunities" reflect general possibilities only — not promises specific to you.
6. Subscriptions (Pros)
Pro subscriptions are flat monthly advertising and marketing-access fees only — not payments for referrals, originated loans, or closed transactions, consistent with the Real Estate Settlement Procedures Act ("RESPA," 12 U.S.C. § 2607). Subscriptions renew automatically until canceled. Full terms are in our Pro Subscription Agreement; billing, refunds, auto-renewal, chargebacks, and tax-collection are governed by our Refund & Cancellation Policy.
7. Buyer communications & TCPA consent
When you submit a callback request, contact form, lead message, or other inquiry through the Service and provide a phone number, you expressly consent to be contacted by BluebonnetBuyer and the matched Texas-licensed real estate or lending professional at the phone number and email you provide, including by call, prerecorded or artificial-voice message, SMS/text message, and email, regarding your inquiry and related homeownership-assistance information. Standard message and data rates may apply; message frequency varies. Consent is not a condition of any purchase or of receiving educational information. You may revoke consent at any time by replying STOP to any SMS or emailing info@bluebonnethomesavings.com.
8. Acceptable use
You may not, and you may not assist anyone else to:
- submit false, misleading, or impersonated buyer or Pro information;
- scrape, crawl, harvest, resell, sublicense, or republish Service data;
- solicit buyers outside the Buyer Matching workflow or otherwise circumvent the platform's matching, accounting, or fee structure;
- discriminate, steer, or refuse service based on protected class (see our Fair Housing Statement);
- enter into any kickback, fee-split, or thing-of-value arrangement for the referral of settlement-service business in violation of RESPA;
- market or describe BluebonnetBuyer as endorsing, guaranteeing, or having selected any particular Pro, lender, rate, program, or outcome;
- send automated calls or texts in violation of the Telephone Consumer Protection Act ("TCPA") or applicable state telemarketing laws;
- upload malicious code, attempt unauthorized access, or probe the Service for vulnerabilities without prior written authorization;
- use the Service to violate any applicable federal, state, or local law, including securities, lending, real-estate, fair-housing, anti-discrimination, consumer-protection, and privacy laws.
9. User content & license to us
You retain ownership of content you submit to the Service (e.g., inquiry messages, Pro bios, uploaded documents). You grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, reproduce, and display that content solely to operate, secure, and improve the Service and to perform the matching, communication, and compliance functions described in these Terms. You represent and warrant that you have all rights necessary to grant this license and that your content does not violate any law or any third party's rights.
10. Intellectual property
The Service, including all content (other than user content), software, calculators, code, design, copy, logos, and trademarks, is owned by BluebonnetBuyer or its licensors and is protected by copyright, trademark, and other intellectual-property laws. Subject to your compliance with these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for its intended personal, non-commercial purpose (or, for Pros, the licensed purpose described in the Pro Subscription Agreement). No other rights are granted by implication.
11. Disclaimers
THE SERVICE AND ALL CONTENT, TOOLS, CALCULATORS, AND PROFESSIONAL INTRODUCTIONS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, ACCURACY, QUIET ENJOYMENT, AND NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, secure, error-free, or that any defect will be corrected. We do not warrant the accuracy, completeness, currency, or reliability of any program information, calculator output, third-party data, or Pro listing. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.
12. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL BLUEBONNETBUYER, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, GOODWILL, BUSINESS OPPORTUNITIES, DATA, OR HOME-PURCHASE OPPORTUNITIES, ARISING OUT OF OR RELATING TO THESE TERMS, THE SERVICE, ANY PROGRAM INFORMATION, ANY PRO OR THIRD PARTY, OR ANY REAL-ESTATE OR LENDING TRANSACTION, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
OUR AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID US IN THE 3 MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100). These limitations form an essential basis of the bargain between you and us and apply regardless of the form of action (contract, tort, statute, or otherwise).
13. Indemnification
You agree to defend, indemnify, and hold harmless BluebonnetBuyer and its officers, directors, employees, and agents from and against any claim, demand, loss, liability, damage, judgment, settlement, or expense (including reasonable attorneys' fees and costs) arising out of or relating to (a) your access to or use of the Service; (b) your content; (c) your breach of these Terms, the Disclosures, the Privacy Policy, or any law; (d) your infringement of any third-party right; or (e) any transaction or dispute between you and a Pro or other third party.
14. Binding individual arbitration & class-action waiver
Please read carefully — this section affects your legal rights and limits your ability to bring a lawsuit or class action. Except for small-claims matters within the jurisdictional limit of a small-claims court and requests for injunctive relief to protect intellectual property or confidential information, any dispute, claim, or controversy arising out of or relating to these Terms or the Service (a "Dispute") will be resolved by final and binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules in effect at the time the arbitration is commenced. The arbitration will take place in Dallas County, Texas (or, at the consumer's option, remotely). The arbitrator has authority to grant any remedy a court could grant, but only on an individual basis. YOU AND BLUEBONNETBUYER EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN ANY CLASS ACTION, CLASS ARBITRATION, CONSOLIDATED ACTION, OR REPRESENTATIVE PROCEEDING to the fullest extent permitted by law. You may opt out of this Section 14 by emailing admin@bluebonnethomesavings.com within 30 days of first accepting these Terms with the subject line "Arbitration Opt-Out" and your full name, email, and mailing address.
15. Governing law & venue
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-laws principles. Subject to Section 14, the state and federal courts located in Dallas County, Texas will have exclusive jurisdiction over any matter not subject to arbitration, and you consent to personal jurisdiction and venue there.
16. Termination & suspension
We may suspend or terminate your access to the Service, with or without notice, for any violation of these Terms, applicable law, or for any reason in our reasonable discretion. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, arbitration, governing law, and any accrued payment obligations) will survive.
17. Changes
We may update these Terms from time to time. Material changes will be posted with a new "Updated" date and, where appropriate, notified by email or in-product notice. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.

19. Miscellaneous
These Terms, together with the Privacy Policy, Disclosures, Fair Housing Statement, and (for Pros) the Pro Subscription Agreement and Refund & Cancellation Policy, constitute the entire agreement between you and us regarding the Service and supersede all prior agreements. If any provision is held unenforceable, the remaining provisions will remain in full force. Our failure to enforce any provision is not a waiver. You may not assign these Terms without our prior written consent; we may assign these Terms in connection with a merger, acquisition, financing, or sale of assets. There are no third-party beneficiaries.
